Terms of Service

1. Acceptance of Terms

By creating an account or using TaleKept, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the service.

2. Description of the Service

TaleKept is a web application (Progressive Web App) designed as a companion to physical family memoir books ("Tell me your story" type books). The service allows you to:

  • Digitize handwritten book pages using OCR (optical character recognition)
  • Type responses or use speech-to-text dictation.
  • Publish your book as an online blog, accessible via a shareable link.
  • Build a visual family tree.
  • Track your progress filling out your book.

TaleKept is provided free of charge, but requires the purchase of a compatible physical book containing a unique activation code to access full functionality.

3. Relationship with the Physical Book

TaleKept does not manufacture, sell, or distribute the physical books. The physical books are sold by third-party retailers. TaleKept is not responsible for the quality, availability, or condition of physical books. TaleKept's sole responsibility is to provide the digital companion service once a valid activation code has been entered.

4. User Accounts

4.1 Account Creation

  • You must be at least 16 years old to create an account.
  • You must provide accurate and complete information.
  • One account per email address.
  • You are responsible for maintaining the confidentiality of your password.

4.2 Account Security

You are responsible for all activities that occur under your account. If you suspect unauthorized access, please contact us immediately via our contact form.

4.3 Account Suspension and Termination

TaleKept reserves the right to suspend or terminate your account at any time if you violate these Terms of Service, without prior notice.

5. User Content and License

5.1 Your Content

You retain all ownership rights to the content you create, upload, or publish on TaleKept, including scanned images, typed text, photos, and family tree information.

5.2 License to TaleKept

By using the service, you grant TaleKept a non-exclusive, worldwide, royalty-free license to host, store, process (including OCR), display, and transmit your content solely for the purpose of operating and providing the service. This license terminates when you delete your content or your account.

5.3 Your Responsibilities

You represent and warrant that:

  • You own or have the necessary rights to all content you submit.
  • Your content does not infringe any third party's intellectual property or privacy rights.
  • You have obtained consent from any living individuals whose personal information (names, photos, stories) you include in your book or family tree.

6. Third-Party Data and Family Tree

When entering information about other people in your family tree or book content, you are solely responsible for:

  • Obtaining their consent before entering their personal data.
  • Ensuring the accuracy of the information.
  • Respecting their right to privacy.

TaleKept is not liable for any privacy violations resulting from user-entered data about third parties.

7. Acceptable Use Policy

7.1 Prohibited Content

You may not publish or upload content that is:

  • Illegal, fraudulent, or deceptive.
  • Defamatory, libelous, or slanderous.
  • Hateful, discriminatory, or promoting violence against any group.
  • Pornographic, sexually explicit, or obscene.
  • Harassing, threatening, or abusive toward any individual.
  • Infringing on copyrights, trademarks, or other intellectual property rights.

7.2 Prohibited Activities

You may not:

  • Reverse engineer, decompile, or disassemble any part of the service.
  • Use automated tools to scrape, crawl, or extract data from the service.
  • Attempt to exploit security vulnerabilities or interfere with the service's operation.
  • Use stolen, counterfeit, or fraudulently obtained activation codes.
  • Create multiple accounts to circumvent restrictions.
  • Use the service for commercial purposes without authorization.

7.3 Consequences

Violations may result in:

  • Warning and request to remove offending content.
  • Temporary suspension of your account.
  • Permanent termination of your account and deletion of all data.
  • Reporting to appropriate authorities if required by law.

8. OCR Accuracy Disclaimer

The OCR (optical character recognition) technology used by TaleKept is provided by third-party services and is not guaranteed to be 100% accurate, especially for handwritten text. You should always review and correct the recognized text. TaleKept is not responsible for errors in OCR transcription.

9. Publications and Sharing

9.1 Visibility Control

You control who can access your published book:

  • Public — accessible to anyone with the link.
  • Password-protected — requires a password you set.

9.2 Content Moderation

TaleKept reserves the right to remove or block any published content that violates these Terms of Service. Books that violate our policies may be blocked, and the account holder will be notified.

9.3 Publication Duration

Published books remain accessible for the duration you configure. TaleKept reserves the right to remove inactive publications after an extended period of inactivity.

10. Limitation of Liability

10.1 "As Is" Basis

TaleKept is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10.2 No Guarantees

TaleKept does not guarantee:

  • Continuous, uninterrupted, or error-free service.
  • The accuracy, completeness, or reliability of OCR results.
  • That the service will meet your specific requirements.
  • The preservation of your data beyond stated retention periods.

10.3 Limitation

To the maximum extent permitted by applicable law, TaleKept and Pyrenees Trading LLP shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or business interruption.

11. Indemnification

You agree to indemnify, defend, and hold harmless Pyrenees Trading LLP, its partners, officers, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your content, or your violation of these Terms.

12. Account Deletion and Data

12.1 Voluntary Deletion

You may delete your account at any time through Settings > Danger Zone > Delete my account.

12.2 Grace Period

After requesting deletion, your account enters a 30-day grace period during which your books remain recoverable. After this period, all data is permanently and irreversibly deleted, including all images stored in our cloud storage.

13. Changes to These Terms

TaleKept may modify these Terms of Service at any time. For material changes, we will notify you by email. Your continued use of the service after changes are posted constitutes your acceptance of the modified terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of British Columbia, Canada, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of British Columbia, Canada.

For consumers in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms of Service, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and Pyrenees Trading LLP regarding your use of TaleKept.
