Copyright Policy

1. Introduction

Pyrenees Trading LLP ("TaleKept") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of the United States, the EU Copyright Directive, and other applicable international copyright laws, we will respond to valid notices of alleged copyright infringement.

2. Reporting Copyright Infringement

If you believe that content published on TaleKept infringes your copyright, you may submit a takedown notice containing the following information:

  1. Identification of the copyrighted work — a description of the work you claim has been infringed.
  2. Identification of the infringing content — the URL or description of where the infringing content is located on TaleKept.
  3. Your contact information — your full name and a way for us to contact you.
  4. Statement of good faith — a statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy — a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.
  6. Your signature — your physical or electronic signature.

Please submit your takedown notice through our contact form with the subject line "DMCA Takedown Request".

3. Counter-Notification

If your content was removed or disabled as a result of a takedown notice and you believe this was done in error, you may submit a counter-notification containing:

  1. Identification of the removed content — a description of the content that was removed and where it was located before removal.
  2. Statement under penalty of perjury — a statement that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
  3. Your contact information — your full name and a way for us to contact you.
  4. Consent to jurisdiction — a statement that you consent to the jurisdiction of the courts of British Columbia, Canada, and that you will accept service of process from the person who filed the original takedown notice.
  5. Your signature — your physical or electronic signature.

Process After Counter-Notification

Upon receiving a valid counter-notification, we will forward it to the party that filed the original takedown notice. If the original complainant does not file a court action within 10 to 14 business days, we may restore the removed content.

4. Repeat Infringer Policy

TaleKept maintains a policy regarding repeat infringers:

  • First offense: Content removal and warning.
  • Second offense: Content removal and account suspension (temporary).
  • Third offense: Permanent account termination and deletion of all associated data.

TaleKept reserves the right to terminate the account of any user who is found to be a repeat infringer, at our sole discretion.

6. Good Faith

Please note that submitting a false or misleading takedown notice or counter-notification may result in legal liability. We encourage you to consult with a legal professional before submitting a notice if you are unsure whether your copyright has been infringed.
